1. Introduction

These Terms of Service ("Terms") govern your access to and use of Essayence, including all related websites, services, and content provided by Elegant Ventures Kenya Limited ("we," "us," or "our"). By using or accessing Essayence, you agree to comply with these Terms and all applicable laws and regulations. If you do not agree, you may not access or use the platform.

Essayence is an academic-support platform that provides editing, consulting, student productivity tools, and educational assistance to students and professionals. These Terms form a binding agreement between you and Elegant Ventures. Your continued use constitutes acceptance of all current and future revisions to these Terms.

2. Definitions

For the purposes of this document:

• "Platform" means the Essayence website, www.essayence.net, and any associated subdomains or digital platforms owned by Elegant Ventures.
• "User," "Client," or "You" refers to any individual or entity accessing or using the Platform or its Services.
• "Services" refers to all products and features provided by Essayence, including but not limited to academic or professional editing, research assistance, admissions consulting, Notion (or other) templates, community forums, and blog content.
• "Content" means any material, text, data, image, or file provided, uploaded, or made available by Essayence or its users.
• "Digital Products" refers to downloadable materials, such as templates or guides, available for purchase or free access.

3. Eligibility

You must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction to access or use our Services. If you are under eighteen, you may only use the Services under the supervision of a parent or guardian who agrees to these Terms.

By accessing Essayence, you represent that you are legally capable of entering into a binding contract and that your use will comply with all applicable academic and institutional integrity policies. Essayence strictly prohibits use for academic dishonesty, plagiarism, or submission of edited material as original work without proper disclosure.

4. Description of Services

Essayence provides academic support services intended solely for educational improvement and personal development. The Services include:

• Academic Editing and Proofreading: correction of grammar, structure, and tone while preserving authorship integrity.
• Research Assistance: advisory support in topic selection, design, formatting, and defense preparation.
• Admissions Consulting: guidance for personal statements, recommendation letters, and scholarship essays.
• Digital Templates: productivity tools and study planners offered through Notion or downloadable files.
• Blog and Community Access: academic content and moderated online spaces for peer learning.

Essayence does not provide ghostwriting or any service that misrepresents authorship or violates academic policies. All outputs are advisory in nature and must be used ethically. We reserve the right to update the services and products any time as the business grows.

5. User Responsibilities

Users agree to provide accurate and complete information when engaging Essayence Services. You are responsible for maintaining the confidentiality of your account credentials and any personal data shared.

You agree not to share purchased materials, duplicate digital products, or distribute Essayence resources without written permission. You further agree to use all services lawfully, ethically, and solely for educational purposes consistent with institutional guidelines.

6. Prohibited Uses

Users shall not:

• Use the Platform to promote or participate in academic dishonesty or plagiarism.
• Access or tamper with servers, systems, or networks associated with Essayence.
• Transmit any malicious code, spam, or unauthorized advertisements.
• Impersonate another person, misrepresent authorship, or falsify credentials.
• Upload, share, or store illegal, defamatory, or infringing content.

Any breach of this section constitutes immediate grounds for account suspension or termination and/or report to your respective institutional authorities without notice.

7. Payments and Refund Policy

All payments for Services must be made in full at the time of order unless expressly agreed otherwise. Prices are displayed in United States Dollars (USD) or Kenyan Shillings (KES) as applicable. Sometimes in your local currency.

Accepted payment methods include credit/debit cards, PayPal, and World Remit, Remitly, SendWave, CashApp and other international money transfer platforms based on the client's preference. They will be displayed on the website, so be sure to check the recommended and available options.

Refunds are only available before service commencement or under exceptional circumstances at our discretion. In case there is an understanding between the platform and the user, up to 50% of the funds will be refunded within 7 days of the agreement. Digital products such as templates are non-refundable once downloaded or accessed.

Recurring subscriptions may be canceled at any time through the user account portal. Cancellations take effect at the end of the current billing cycle.

8. Intellectual Property Rights

All content, branding, trademarks, graphics, and software associated with Essayence are the property of Elegant Ventures or its licensors. Users may not reproduce, distribute, or exploit any portion of the Platform without express written consent.

Clients retain ownership of their original documents and intellectual work submitted for review. Essayence holds a limited right to use anonymized excerpts solely for internal quality review and improvement.

9. Confidentiality and Data Protection

Essayence treats all client documents and personal data with strict confidentiality. Files and communications are securely stored and accessible only to authorized personnel for the purpose of providing services.

We do not sell, rent, or disclose client information to third parties except where required by law. Data handling is subject to the Essayence Privacy Policy, which forms part of these Terms.

10. Limitation of Liability

Essayence provides its Services "as is" without warranties of any kind, express or implied. We do not guarantee specific academic or professional outcomes, including grades, admissions, or awards.

In no event shall Elegant Ventures, its affiliates, or representatives be liable for any indirect, incidental, or consequential damages arising from your use of the Services. The maximum aggregate liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Modifications and Service Availability

We reserve the right to modify, suspend, or discontinue any part of the Platform or Services at any time without prior notice. We are not liable for any interruption, delay, or data loss resulting from maintenance, updates, or technical issues beyond our control.

Users are encouraged to regularly review these Terms for updates. Continued use following changes signifies acceptance of the revised Terms.

12. Account Suspension and Termination

Essayence reserves the right to suspend or terminate user accounts for violations of these Terms, unlawful activity, or misuse of Services. Upon termination, all rights to access the Platform and its content cease immediately.

Users may request account closure at any time by contacting support. Termination does not relieve the user of any outstanding payment obligations or liabilities.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from or relating to these Terms shall first be addressed through good faith negotiation between the parties.

If unresolved, disputes may be referred to arbitration under the Kenyan Arbitration Act. The decision of the appointed arbitrator shall be final and binding. Venue and jurisdiction shall be in Nairobi, Kenya.

14. Amendments and Notices

Essayence reserves the right to amend these Terms at its discretion. Any material change will be communicated via email or public notice on the website. The effective date of revision will be clearly stated at the top of the document.

Your continued use of the Platform after any amendment constitutes acceptance of the updated Terms. If you disagree with the changes, you must discontinue use of the Services immediately.
